Will Military Service Members Have Access to CBD?

On July 20, 2020 the U.S. House of Representatives approved an amendment to the National Defense Authorization Act (NDAA) to allow U.S. military members to use hemp products, including CBD. 

“The Secretary of Defense may not prohibit, on the basis of a product containing hemp or any ingredient derived from hemp, the possession, use, or consumption of such product by a member of the Armed Forces” as long as the crop meets the federal definition of hemp and that “such possession, use, or consumption is in compliance with applicable Federal, State, and local law.”

The amendment, sponsored by Representative Tulsi Gabbard of Hawaii, comes in response to a Department of Defense policy banning the use of hemp products by active duty and reserve members of the military. Unfortunately, the amendment was not included in the Senate’s version of the NDAA, which passed on July 23. The NDAA will now move to the conference committee process, where negotiations between the House and Senate will take place over the next several days. If the House amendment is included in the final conference version, the new law will invalidate Army and Air Force policies that ban the use of hemp products, as well as policies by the Navy and Marine Corps that limit acceptable use to topical products.
